O PROBLEMA DO LICENCIAMENTO DE GRANDES EMPREENDIMENTOS PRIVADOS EM FACE DO DIREITO URBANÍSTICO: ANÁLISE DE UM CASO EMBLEMÁTICO NA PERIFERIA DA REGIÃO METROPOLITANA DO RIO DE JANEIRO.

Este ensaio visa refletir sobre as questões de tradução levantadas por Jacques Derrida (1987), questões essas que não chegam a formalizar uma teoria da tradução, mas têm elas o ato de traduzir o original como veredas a ser percorridas por um sujeito endividado, ou seja, o tradutor. No dizer de Derrida, “a tarefa do tradutor indica a lei e a missão outorgada pelo outro a que o tradutor deve responder”. Neste sentido, entendemos aqui a tradução como um ato de diálogo, (...) de negociação, uma vez que a língua, nesta perspectiva, é aquilo que não se deixa possuir. Com isso, os problemas da tradução são - de um lado - o problema da língua, de sua natureza heterogênea, fugidia; e, do outro, do modelo tradicional de tradução que se apoia na concepção de língua como algo homogêneo em que a diversidade, o diferente são vistos como pecado, como transgressão da linguagem (adâmica). Utilizando a abordagem discursivo-desconstrutiva, este trabalho busca refletir sobre a política linguística nacional veiculada nos Parâmetros Curriculares Nacionais de Português (ensino fundamental) cujo discurso se traduz em um método sofisticado de controle e em uma forma eficaz de gerir a mudança (LAWN, 2001, p. 117) para impor uma nova identidade ao professor. Através dessa abordagem, pretende-se apresentar e discutir os resultados analisados, cujo foco recai sobre as representações da (s) identidade (s) e competências construídas para os professores neste discurso, representações (...) sociais da profissão do professor na sociedade contemporânea brasileira, marcada pelos acontecimentos que sucederam ao período ditatorial, portanto, a fase de redemocratização do país e de modernização do Estado frente às exigências da mundialização. Nessa perspectiva, pensamos em e com Foucault (1996, p. 45) quando afirma que “todo sistema de educação é uma maneira política de manter ou de modificar a apropriação dos discursos, com os saberes e os poderes que eles trazem consigo”. A tensão que a objetividade promove na subjetividade do ser social, proporcionada pela arte realista, possibilita ao homem se aproximar dos ritmos das contradições da realidade. Isso permite ao homem aguçar sua crítica e buscar sua emancipação. Acreditamos que uma prática escolar sustentada pela necessidade de se apropriar da cultura clássica com as múltiplas contradições da realidade constitui-se numa alternativa para proporcionar uma Educação (...) crítico-emancipatória. Resumo: O problema básico a cuja resposta se almeja nesse artigo é o problema geral da epistemologia da filosofia da religião: é possível falar de uma racionalidade, de um modo geral, do e no discurso religioso? É racional, a título de exemplo, falar-se – e, mais ainda, defender – proposições como “há vida depois da morte”, “existe Deus”, “a alma reencarna e é eterna”, “Jesus ressuscitou ao terceiro dia” etc.? Para uma plêiade de autores a resposta é negativa; para uma (...) outra parcela, por outro lado, a resposta é justamente a oposta. Em ambos os casos, não discutiremos o conteúdo da defesa daqueles ou que negam ou que defendem a racionalidade de uma proposição como as mencionadas, mas focalizaremos na concepção de subjetividade subjacente às teses negativas. Esse trabalho, assim, pretende apresentar uma proposta alternativa de defesa do discurso religioso. Em um primeiro momento, busca-se evidenciar que a desconsideração do caráter racional do discurso (ou proposições) religioso pressupõem uma concepção deflacionária de racionalidade. Intentar-se-á evidenciar que essa concepção “deflacionária” de racionalidade é dependente de certa tradição empirista. O segundo segmento inicia com um apontamento das fragilidades de uma tal concepção de racionalidade, abrindo-se espaço, portanto, para a apresentação de uma posição inferencialista a partir de Wilfrid Sellars (1912-1989). Conclui-se, portanto, pela racionalidade do discurso religioso, na medida em que se explicita a falsa pressuposição, uma concepção reducionista de subjetividade, das teses que negam tal possibilidade. Objective: To explore the strategies that can help individuals mourning a family member’s death from Covid-19 to cope with the loss. Method: We carried out a narrative review on the PubCovid-19 platform using the descriptors “death,” “mourning,” “Covid-19,” and “coping strategies.” Ten articles were included. Results: The strategies found are phone calls, audio recording, letters, and photos, classified as immediate and long-term. These strategies are focused on mental health, which can be adversely affected by depression and psychological disorders. Conclusions: Creating (...) counseling programs for the relatives of those who died from Covid-19 is urgent. They must offer comprehensive, humanized, and continuous mental health care. (shrink)

Nosso objetivo é destacar o sentido filosófico no Brasil dos primeiros debates suscitados pela ideia de uma psicologia científica. Para tanto, trabalharemos com os textos de dois autores em especial, Gonçalves de Magalhães e Tobias Barreto. Nosso interesse é o de demonstrar em que sentido estes filósofos foram capazes de oferecer oposição a uma tendência positiva vigente na Psicologia e, ao mesmo tempo, superar o caráter contemplativo da consciência de si inerente à Psicologia sob a égide dos Jesuítas, e (...) em vista da necessidade de modernização filosófica no Brasil. Ao mesmo tempo, pretendemos mostrar que, a despeito da crítica de Tobias a Magalhães, ambos souberam reconhecer a significação do naturalismo em Psicologia, especialmente no que diz respeito à tarefa de inserir o pensamento brasileiro nos rumos da filosofia ocidental. Intentionalism about demonstratives is the view that the referent of a demonstrative is determined solely by the speaker's intentions. Intentionalists can disagree about the nature of these intentions, but are united in rejecting the relevance of other factors, such as the speaker's gestures, her gaze, and any facts about the addressee or the audience. In this paper, I formulate a particular version of this view, and I defend it against six objections, old and new.

La tradición analítica en el periodo de la institucionalización de la filosofía, plantea la discusión sobre las líneas filosóficas, demostrando la existencia de cierta tradición analítica en Chile. A partir de allí, reflexionamos en torno a los procesos de constitución del campo de la filosofía en Chile como una historia atravesada por la necesidad de préstamos y cruces que impiden una delimitación clara de sus límites, lo que tornaría necesaria la atención a (...) ciertas políticas de la lectura que el libro soslaya. La productividad de la filosofía producida en Chile surgiría gracias -y no pese- a su inscripción en sus tiempos y espacios, a partir de recepciones cuya ausencia de retraso no impide el gesto de cierto re-trazo de lo leído. Alex Ibarra's exposition in his book Filosofía chilena. La tradición analítica en el periodo de la institucionalización de la filosofía, places the discussion on the philosophical traditions, showing the existence of a certain kind of analytical tradition in Chile. From there, we expose the processes of constitution of the field in Chile as a history crossed by the need of importations and intersections that contest the clear delimitation of its boundaries, what makes necessary the attention of the politics of readings that the book avoid. The productivity of the philosophic production in Chile, arises thanks to -but not in spite of- its inscription in its age/times and spaces, coming from its receptions and its differences. (shrink)

Soren Kierkegaard's Works of Love, a series of deliberations on the commandment to love one's neighbor, has often been condemned by critics. Here, Ferreira seeks to rehabilitate Works of Love as one of Kierkegaard's most important works. He shows that Kierkegaard's deliberations on love are highly relevant to some important themes in contemporary ethics, including impartiality, duty, equality, mutuality, reciprocity, self-love, sympathy, and sacrifice. Ferreira also argues that Works of Love bears on issues peculiar to a religious ethic, (...) such as the role of God as "middle term," and the possibility of preserving the aesthetic dimensions of love in a religious ethic of relation. The evolution and biodiversity of ageing have long fascinated scientists and the public alike. While mammals, including long‐lived species such as humans, show a marked ageing process, some species of reptiles and amphibians exhibit very slow and even the absence of ageing phenotypes. How can reptiles and other vertebrates age slower than mammals? Herein, I propose that evolving during the rule of the dinosaurs left a lasting legacy in mammals. For over 100 million years when dinosaurs were the dominant predators, (...) mammals were generally small, nocturnal, and short‐lived. My hypothesis is that such a long evolutionary pressure on early mammals for rapid reproduction led to the loss or inactivation of genes and pathways associated with long life. I call this the ‘longevity bottleneck hypothesis’, which is further supported by the absence in mammals of regenerative traits. Although mammals, such as humans, can evolve long lifespans, they do so under constraints dating to the dinosaur era. (shrink)

Common principles for resource allocation in health care can prioritize the alleviation of small health burdens over lifesaving treatment. I argue that there is some evidence that these principles are at odds with a sizable share of public opinion, which holds that saving a life should take priority over any number of cures for minor ailments. I propose two possible explanations for this opinion, one debunking and one vindicatory. I also outline how well-designed surveys and moral inquiry could help decide (...) between them. Finally, I consider how priority-setting principles could be adjusted if the view that saving a life always trumps alleviating small burdens were vindicated. (shrink)

They arise from the potentially conflicting interests between those of the pre-existing child, the subject of a treatment which may be curative, and those of the sibling to be created, who cannot give consent to the donation, together with the problem of the destruction of potentially healthy embryos. The novel My Sister’s Keeper, by Jodi Picoult, provides the reader with an in-depth view of the conflicting interests and emotional problems that affect the Fitzgeralds, a family experiencing the pain of seeing one of their children dying while facing the tragic consequences of trying to save this child by having another offspring. The elite theory of Max Weber has recently been rediscovered by political scientists and political theorists who have sought to explore both the heuristic and the normative potential of plebiscitary leader democracy. Notwithstanding the merits of this wave of studies, this paper argues that attention should be shifted from Weber's context-specific defence of plebiscitary leadership in post-WWI Germany to his broader conception of charisma as an attempt to grasp the enigma of significant social and political change. Contemporary democratic theory, this (...) paper contends, can fruitfully draw on Weber to sink into the antinomies and ambiguities of a transformative democratic politics. (shrink)

This paper introduces a symposium on Equality versus Priority. It explains how cases involving risk are key to distinguishing these views and discusses a 'social egalitarian' critique of both 'telic egalitarians' and 'telic prioritarians'.

Time passes iff: P and then Q, for any tensed P and Q. Mary sits; and then she stands. The view—dynamic succession—accommodates the intuition that time passes when events change their A-characteristics: my next birthday is 11 months future and then 10 months future and so on. The view implies an intimate connection between passage, persistence, and change. Persistence and change both presuppose passage. The view charts a path between A-theories (invoking past, present, future) and B-theories (invoking succession). A-theories of (...) passage fail to uncover what makes the passage process go (i.e., succession). B-theories negate tense and therefore mistakenly treat succession as a static relation. When A utters a declarative sentence in a context to B, typically A can mean a proposition by the sentence, the sentence in context literally expresses a proposition, there are propositions A and B can agree the sentence literally expressed, and B can acquire knowledge from this testimonial exchange. In recent work on linguistic communication, each of these four platitudes has been challenged, and on the same basis: viz. on the ground that exactly which proposition the sentence expressed in context (...) is not discernible given the information provided by the context. I argue that, even if this is true, there will be propositional parts of the proposition expressed by the sentence in context which can be identified and that, consequently, the partial understanding afforded by the existence of such identifiable parts undermines the soundness of the arguments against the platitudes. It seems possible to see a star that no longer exists. Yet it also seems right to say that what no longer exists cannot be seen. We therefore face a puzzle, the traditional answer to which involves abandoning naïve realism in favour of a sense datum view. In this article, however, I offer a novel exploration of the puzzle within a naïve realist framework. As will emerge, the best option for naïve realists is to embrace an eternalist view of time, (...) and claim that in the relevant case, one sees a still existent star‐stage located somewhere in the distant past. The increasing use of digital technologies in judicial and arbitration proceedings increases the usage of digital evidence by the parties, which brings the necessity of creating patterns for adjudicators to admit and assess this new type of evidence. This paper generally addresses digital evidence focusing on the second moment in international arbitration proceedings. It also narrows the topic to hacked and leaked evidence and its admissibility in international arbitration. The literature review showed a significant amount of research devoted to the (...) evidence in arbitration. Some considered electronic evidence within one jurisdiction; others focused on certain forms of digital evidence such as electronic signatures. Papers on digital evidence in international arbitration approach arbitration rules for digital evidence but skip admissibility issues. No systemic and complex works research digital evidence in arbitration, explicitly focusing on the admissibility of hacked and leaked digital evidence from a comparative perspective. Also, no research deals with enforcing international arbitration awards relying on illegally obtained digital evidence. In these cases, there could be a possible violation of domestic public policy under the New York Convention terms (art. V, 2, b). That is why the paper aims to offer the concept of digital evidence in international arbitration, including hacked and leaked evidence, criteria of its admissibility and relevance, and design the arbitration guidelines for assessing hacked and leaked evidence. Comparative legal analysis of the international arbitration rules and national procedure law allowed us to compare the regulatory approaches to the definition of digital evidence and its admissibility worldwide. The method of legal modeling allowed designing model guidelines for arbitral tribunals to evaluate the admissibility and relevance of digital evidence, including hacked and leaked evidence. Moreover, the case study method allowed us to analyze jurisprudence and define criteria for admission of hacked and leaked evidence. We conclude that the admissibility of hacked and leaked evidence depends solely on the arbitrator’s broad discretion to assess the evidence. Nevertheless, thorough evidence analysis and a well-reasoned award are always mandatory. (shrink)

Despite recent progress in the identification of genes that regulate longevity, aging remains a mysterious process. One influential hypothesis is the idea that the potential for cell division and replacement are important factors in aging. In this work, we review and discuss this perspective in the context of interventions in mammals that appear to accelerate or retard aging. Rather than focus on molecular mechanisms, we interpret results from an integrative biology perspective of how gene products affect cellular functions, which in (...) turn impact on tissues and organisms. We review evidence suggesting that mutations that give rise to features resembling premature aging tend to be associated with cellular phenotypes such as increased apoptosis or premature replicative senescence. In contrast, many interventions in mice that extend lifespan and might delay aging, including caloric restriction, tend to either hinder apoptosis or result in smaller animals and thus may be the product of fewer cell divisions. Therefore, it appears plausible that changes in the number of times that cells, and particularly stem cells, divide during an organism's lifespan influence longevity and aging. Este artigo, apoiado na perspectiva teórica sócio-histórico-cultural, discute a atividade na qual sujeitos se envolvem como constitutiva dos papeis sociais que exercem. Objetiva desencadear discussão acerca da dinâmica discursiva em contextos de formação crítico-colaborativa de professores, focalizando os discursos de autoridade e internamente persuasivo (BAKHTIN, 2010) e sua coocorrência nas situações de negociação de significados. Tal distinção constitui-se relevante por permitir compreender diferentes enunciados argumentativos ou não, proferidos por educadores em formação, que se proximam ou se distanciam daqueles proferidos por (...) seus formadores ou por vozes teóricas isoladas da prática, indicando possibilidades de criação ou diminuição da expansão dialógica. A partir da ênfase no discurso internamente persuasivo, procura-se destacar o papel crítico-colaborativo da argumentação na formação de educadores. Exemplos selecionados de um corpus de pesquisa coletado em escola pública de São Paulo subsidiará a discussão, por sua vez, apoiada em Bakhtin (2010) e Vygotsky (1998; 2001). (shrink)

Endre Begby’s Prejudice: A Study in Non-Ideal Epistemology engages a wide range of issues of enduring interest to epistemologists, applied ethicists, and anyone concerned with how knowledge and justice intersect. Topics include stereotypes and generics, evidence and epistemic justification, epistemic injustice, ethical-epistemic dilemmas, moral encroachment, and the relations between blame and accountability. Begby applies his views about these topics to an equally wide range of pressing social questions, such as conspiracy theories, misinformation, algorithmic bias, discrimination, and criminal justice. Through it (...) all, the book’s central thesis is that prejudices can be epistemically rational, a corrective against what Begby takes to be the received view that prejudices are always and everywhere bad. However, Begby’s arguments do not engage consistently with relevant empirical literatures, misrepresent the positions of his interlocutors, and rehearse ideas already well-established across a range of intellectual traditions. One very popular framework in contemporary epistemology is Bayesian. The central epistemic state is subjective confidence, or credence. Traditional epistemic states like belief and knowledge tend to be sidelined, or even dispensed with entirely. Credences are often introduced as familiar mental states, merely in need of a special label for the purposes of epistemology. But whether they are implicitly recognized by the folk or posits of a sophisticated scientific psychology, they do not appear to fit well with perception, as is (...) often noted. -/- This paper investigates the tension between probabilistic cognition and non-probabilistic perception. The tension is real, and the solution—to adapt a phrase from Quine and Goodman—is to renounce credences altogether. (shrink)

Culling is used in traditional public health policies to control animal populations. These policies aim primarily to protect human interests but often fail to provide scientific evidence of effectiveness. In this article, we defend the need to move from a strictly anthropocentric approach to disease control towards a One Health ethics, using culling practices as an example. We focus on the recent badger culls in the UK, claiming that, based on data provided by the English Government, these culls may be (...) unjustified, all thing considered. We highlight the relevance of ethical reasoning rooted in One Health for this discussion, and make several suggestions including a moratorium on culling until data are provided to support the effectiveness of culling; to conduct a randomized trial to compare proactive culling with alternative methods; to apply deliberative democratic methods to assess public opinion towards the culls, and to find in Brexit an opportunity for aiming for more effective control measures. This fascinating and thought-provoking book provides much-needed philosophical background for counselors, therapists, and healthcare workers looking for broader, deeper foundations in the struggle to help and make sense of others. While examining the best among 20th century philosophy it shows the wealth of inspiration of earlier centuries, and demonstrates with remarkable clarity the way in which the ideas of, and the relations between, these philosophers can inspire, inform, and underpin much of counseling and psychotherapy.

There are at least two different aspects of our rational evaluation of agents’ doxastic attitudes. First, we evaluate these attitudes according to whether they are supported by one’s evidence (substantive rationality). Second, we evaluate these attitudes according to how well they cohere with one another (structural rationality). In previous work, I’ve argued that substantive and structural rationality really are distinct, sui generis, kinds of rationality – call this view ‘dualism’, as opposed to ‘monism’, about rationality – by arguing that the (...) requirements of substantive and structural rationality can come into conflict. In this paper, I push the dialectic on this issue forward in two main ways. First, I argue that the most promising ways of resisting the diagnosis of my cases as conflicts still end up undermining monism in different ways. Second, supposing for the sake of argument that we should understand the cases as conflicts, I address the question of what we should do when such conflicts arise. I argue that, at least in a prominent kind of conflict case, the coherence requirements take precedence over the evidential requirements. (shrink)

I defend Fricker’s virtue-theoretic proposals for grappling with epistemic injustice, arguing that her account is both empirically oriented and plausible. I agree with Fricker that an integral component of what we ought to do in the face of pervasive epistemic injustice is working to cultivate epistemic habits that aim to consistently neutralize the effects of such prejudices on their credibility estimates. But Fricker does not claim that her specific proposals constitute the only means through which individuals and institutions should combat (...) epistemic injustice. I therefore build on Fricker’s account by beginning to sketch a fuller picture of the structure of cultivating epistemic virtue. Virtue cultivation must, I argue, occur on two broad but interrelated fronts: first, the direct retraining of more automatic and unreflective patterns of thinking, feeling, and reacting to epistemic social reality, and second, the cultivation of more reflective, metacognitive virtues, such as the ability to swiftly identify contexts in which our first-order epistemic intuitions are likely astray. Although I articulate a range of individual-level obligations, my account is not individualistic. With Fricker, I argue that individual self-transformation is a necessary but not sufficient component of the struggle for epistemic justice. Accordingly, I sketch several ways in which individual virtue cultivation must be a socially and institutionally embedded process. Moreover, I argue that this process is ongoing. While most individuals cannot actually achieve such moral-epistemic ideals, many can (and therefore should try to) get much closer than they already are. (shrink)

Epistemologists typically assume that the acquisition of knowledge from testimony is not threatened at the stage at which audiences interpret what proposition a speaker has asserted. Attention is instead typically paid to the epistemic status of a belief formed on the basis of testimony that it is assumed has the same content as the speaker’s assertion. Andrew Peet has pioneered an account of how linguistic context sensitivity can threaten the assumption. His account locates the threat in contexts in which an (...) audience’s evidence under-determines which proposition a speaker is asserting. I argue that Peet’s epistemic uncertainty account of the threat is mistaken and I propose an alternative. The alternative locates the threat in contexts that provide factors that give audiences a mistaken psychological certainty or confidence that a speaker has asserted a proposition she has not. The terminology surrounding the dispute between higher-order and first-order theories of consciousness is piled so high that it sometimes obscures the view. When the debris is cleared away, there is a real prospect.

Research suggests that interventions involving extensive training or counterconditioning can reduce implicit prejudice and stereotyping, and even susceptibility to stereotype threat. This research is widely cited as providing an “existence proof” that certain entrenched social attitudes are capable of change, but is summarily dismissed—by philosophers, psychologists, and activists alike—as lacking direct, practical import for the broader struggle against prejudice, discrimination, and inequality. Criticisms of these “debiasing” procedures fall into three categories: concerns about empirical efficacy, about practical feasibility, and about the (...) failure to appreciate the underlying structural-institutional nature of discrimination. I reply to these criticisms of debiasing, and argue that a comprehensive strategy for combating prejudice and discrimination should include a central role for training our biases away. (shrink)
